There are strict requirements for the filing and perfecting of a claim of lien on real property in Florida

If the proper procedures are not followed prior to filing a lien, the lien may be void and unenforceable against the property. In addition, there are also strict time frames under Florida law in which a party has to file and record a claim of lien. If the the lien is not timely filed and recorded, you may be forever barred from filing a claim of lien on the property.

In many cases, attorneys fees and costs are added to the principle lien amount and must be paid by the debtor. The proper filing of a lien may the only way a creditor is assured that they will eventually be paid money that is owed to them. The proper filing of a lien can be a strong incentive for payment of a debt.

If a lien has been filed on your property or if you have received notice that a lien will be filed, you should seek legal counsel immediately.

The recording of a lien on your property is a serious matter. It is unlikely that you will be able to sell or refinance your property until the lien issue is resolved. The lienor may choose to foreclose on the lien which means the court may order your property to be sold so that the lien can be paid. You may also be responsible to pay the lienor's attorneys fees and costs in addition to losing your property. Therefore it is important that you take prompt measures to preserve your property rights.

You may have defenses to the lien. For instance, if the lien was not filed in strict adherence with Florida law, the lien may be void and unenforceable against your property. If the lien was filed fraudulently or with gross negligence, you may sue the lienor for filing the invalid lien. You may be able to recover your attorneys fees and costs should you prevail in a lien action. Even if the lien is valid you may be able to settle the lien amount for less than is owed.

CONTRACTS

Any contract of substance that you may enter into should be in writing.

A written contract outlines in detail the rights and obligations of each party to the agreement. One size does not fit all, while many transactions are routine, it is important to craft a written agreement that fits the transactional circumstances of which you are involved. The list of contracts that should be in writing are numerous, some examples include; residential and commercial leases, partnership agreements, loan agreements, licensing agreements, agreements affecting real property and purchase and sale agreements.

Florida law requires that certain contracts be in writing in order to be enforceable such as; contracts for the sale of real property, promises to pay the debt of another, promises in consideration of marriage and contract purposes that cannot be performed within one year. Whether a contract is oral or written can substantially affect the time frame which you have to sue on the contract. For example, if you enter into an oral contract and a dispute arises, you may have as little as one year to sue on the contract. After one year you may be forever barred from filing a claim. On the other hand, if the contract is in writing, you may have up to five years to sue on the written contract.
